A personal injury is a type of harm that an individual suffers as a result of someone else’s wrongful act, commonly referred to as negligence. Negligence is the failure to use reasonable care to prevent harm to oneself or to others. A person can be negligent by acting or by failing to act. A person is negligent if he or she does something that a reasonably careful person would not do in the same situation or fails to do something that a reasonably careful person would do in the same situation. When determining whether conduct is negligent or not, the Jury or Judge is asked to decide how a reasonably careful person would have acted in the defendant’s situation.

The types of injuries that can be suffered by negligent or wrongful conduct are numerous and vary depending on the circumstances. Some general examples of injuries are broken bones, ruptured spinal discs, torn tendons or ligaments, torn cartilage, lost sight, severed limbs, burns, traumatic brain injury, and death.

The law provides that a person injured by another’s negligent or wrongful conduct shall, subject to proof, recover compensation for harms and losses which include lost past and future wages, past and future medical bills, and in some instances ongoing life care needs. In addition, the law provides for compensation for physical pain, mental suffering, loss of enjoyment of life, disfigurement, physical, impairment, inconvenience, grief, anxiety, humiliation, and emotional distress. In wrongful death cases, compensable harms include the loss of the family member’s love, companionship, comfort, care, assistance, protection, affection, society, moral support, loss of the enjoyment of sexual relations and the loss of the family member’s training and guidance.
